From the immigration law regulations’ point of view, you should hold a valid job offer from an authorized employer or sponsor before applying for visa. Employment visas are issued to expats who want to work in Dubai or other emirates in UAE. Dubai is one of the seven emirates that make up UAE, and is a destination for people from all over the world. The competent authorities in the UAE have introduced a new system for the entry and exit visas for foreign national employees, or those planning to work in the UAE. This visa is an entry visa only and is called “Labour Card”. The authorities would issue these cards as soon as the company applies for them, after verifying their job offers. Some work visas require you to obtain a formal approval in the country of your residence. You may have heard from friends and relatives that they employed someone abroad before the person entered the country. This is possible only if the company has a Work Permit-Approval Number (WPN). Once approved, the work permit allows the employee to work up to a maximum period of three years. In such circumstances, an employer may seek approval for renewing or extending the initial approval period of employment for those who are 65 and above. The fees for issuing an extension of the authorization for those who are 65 and above is AED 5,000 per year from the extension date. Age is not a factor in terminating the employment contract. However, there is a fee of AED 5,000 for seniors’ work permit renewed every two years.

All companies, both UAE and non-UAE are expected to comply with the Labour Law and accordingly should not terminate the employment of an employee aged 65 and above. An individual who is retiring from work in the UAE may not be asked to give a reason for that, as per the UAE Labour Law No. 8 of 1980. However, he/she may be asked to provide their salary slips at the time of retirement to prove that they are eligible for retirement. The Dubai Government’s decision to exempt retired individuals who are 65 years and above from paying fees for applying for work permits is a positive step. Furthermore, this move will give older workers the opportunity to contribute to our society by continuing their careers through retirement and beyond.

The new regulation was implemented in November 2017 and is applicable while renewing the annual card as well as when an individual applies for a new permit. The Ministry of Human Resources and Emiratisation (MoHRE) recently launched an e-service called Mobile Labour Market Information System (LMIS). LMIS allows establishments to view the profiles of older workers. These fees can be paid annually at any time until the employee turns 70. After the 70th birthday, the renewal fee for additional work permit will be waived until the end of the visa validity.
